GENERAL TERMS AND CONDITIONS

1. Scope

The following terms and conditions apply to all orders placed through our online shop. Our online shop is exclusively intended for consumers.

A consumer is any natural person who concludes a legal transaction for purposes that cannot be attributed primarily to their commercial or self-employed professional activity. An entrepreneur is a natural or legal person or a legally capable partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

2. Contracting Party, Conclusion of Contract, Correction Options

The purchase contract is concluded with Nxtup.

By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can initially place our products in the shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided for this purpose in the ordering process. The contract is concluded by clicking on the order button to accept the offer for the goods contained in the shopping cart. Immediately after sending the order, you will receive a confirmation by email.

3. Contract Language, Storage of Contract Text

The language(s) available for concluding the contract: German, English, French, Spanish, Italian.

We save the text of the contract and send you the order data and our terms and conditions in text form. You can view the contract text in our customer login.

4. Delivery Conditions

In addition to the stated product prices, shipping costs will be added. You can find more information on the amount of shipping costs in the offers.

We only deliver by mail. Self-collection of the goods is not possible.

We do not deliver to packing stations.

5. Payment

In our shop, the following payment methods are available as a rule:

PayPal, PayPal Express
To be able to pay the invoice amount via the payment service provider PayPal (Europe) S.à r.l. et Cie, S.C.A, 22-24 Boulevard Royal, L-2449 Luxembourg ("PayPal"), you must be registered with PayPal, authenticate yourself with your access data and confirm the payment instruction. The payment transaction is carried out by PayPal immediately after the order is placed. Further information will be provided during the ordering process.

6. Reservation of Ownership

The goods remain our property until full payment has been made.

7. Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to make a complaint or contact us will have no consequences for your legal claims and their enforcement, especially your warranty rights. However, you help us to assert our own claims against the carrier or transport insurance.

9. Liability

We are always liable for claims arising from damages caused by us, our legal representatives, or vicarious agents:

in the event of injury to life, body, or health,
in the case of intentional or grossly negligent breach of duty,
for warranties, if agreed, or
to the extent the scope of the Product Liability Act applies.

In the event of a breach of essential contractual obligations, the fulfillment of which enables the proper execution of the contract and on which the contractual partner can regularly rely (cardinal obligations) due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited in amount to the foreseeable damage typical for the contract at the time of conclusion. In all other respects, claims for damages are excluded.

10. Dispute Resolution

The European Commission provides a platform for online dispute resolution (ODR), which you can find here. We are not obligated or willing to participate in a dispute resolution procedure before a consumer arbitration board.

11. Information about the Right of Withdrawal for Consumers

There is no right of withdrawal for contracts for the delivery of goods that are not prefabricated and for the manufacture of which an individual selection or determination by the consumer is decisive or which are clearly tailored to the personal needs of the consumer, which applies to the products in this shop since it is a "print on demand (POD)" shop.

What is "Print on demand"?

Print on demand means: Printing on demand. This means that when a customer buys a product, the product is only produced and shipped after the purchase has been made based on the customer's specifications. Therefore, it is not possible to return these goods, as there is no inventory or other stock, and the product has been customized to the customer.
